INSPECTAHIRE TERMS & CONDITIONS OF WEBSITE USE

This page (together with any documents referred to on it) tells you the terms of use by which you may make use of our websites, the domain names of which are currently located at www.inspectahire.com (“our site or sites”), whether as a guest or a registered user. Please read these terms of use carefully before you use these sites. By indicating your acceptance when you register or use our sites as a guest, you, the user, (“you”) accept these terms of use and agree to abide by them. If you do not agree to these terms of use, please refrain from using our sites. In the event of you breaching any of these terms, your right to use our sites will terminate immediately.


Accessing our sites

Access to our sites is permitted to users on a temporary basis, and we reserve the right to withdraw or amend the service we provide on our sites without notice. We will not be liable if for any reason our sites are unavailable at any time or for any period. From time to time, we may restrict access to some parts of our sites solely to registered users or specific authorised individuals.

If you choose, or are provided with, a user identification code, password or any other identifier or piece of information as part of our security procedures, you must treat such information as confidential and must not disclose it to any third party. We reserve the right to disable any user identification code or password, whether chosen by you or allocated by us, at any time, if in our opinion you have failed to comply with any of the provisions of these terms and conditions.

You are responsible for making all technical arrangements necessary for you to access our sites. You are also responsible for ensuring that all persons who access our sites through your internet connection are aware of these terms, and that they comply with them.


Intellectual property rights

We are the owner or the licensee of all intellectual property rights (including without limitation, any patents, copyright, trademarks, designs, database rights and other proprietary rights) in our sites, their selection and arrangement and in all the material published on them. Our site content is protected by copyright law in the UK and the European Union and by treaty throughout the world. All rights in so far as not granted expressly in these terms are reserved. You may print off one copy, and may download extracts, of any page(s) from our sites for your personal reference and you may draw the attention of others within your organisation to material posted on our sites only for the purpose of using our services.

You must not modify the paper or digital copies of any materials you have printed off or downloaded in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text.

Our status (and that of any identified contributors) as the authors of material on our sites must always be acknowledged. You must not use, distribute or make available any material on our sites for commercial purposes without contacting us to obtain express written permission to do so (which may or may not be granted at our sole discretion).

If you print off, copy or download any part of our sites in breach of these terms of use, your right to use our sites will cease immediately and you must, at our option, return or destroy any copies of the materials you have made.

Our sites change regularly. We aim to update our sites regularly, and may change the content at any time. If the need arises, we may suspend access to all or certain parts of our sites, or close them indefinitely. Any of the material on our sites may become out of date at any given time and although we make reasonable efforts to ensure that any content we post is up to date, we are under no obligation to update or continually check such material.


Our liability

The material displayed on our sites is provided without any representations, conditions or warranties of any kind given (either express or implied) as to its accuracy. No warranty or representation is made or given that the operation of our sites will be error free or uninterrupted or that our sites or our systems are free of viruses or other harmful or destructive components. Except to the extent set out in the paragraph below, we will not be liable for loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of our sites or to your downloading of any material posted on them, or on any website linked to them.

ALL CONDITIONS, WARRANTIES AND OTHER TERMS THAT MIGHT BE IMPLIED BY STATUTE, COMMON LAW OR THE LAW OF EQUITY ARE EXCLUDED TO THE FULL EXTENT PERMITTED BY LAW. WE AND OTHER MEMBERS OF OUR GROUP OF COMPANIES HEREBY EXPRESSLY EXCLUDE LIABILITY TO THE FULLEST EXTENT PERMITTED BY LAW FOR THE FOLLOWING (HOWEVER ARISING AND WHETHER CAUSED BY TORT, DELICT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT OR OTHERWISE, EVEN IF FORESEEABLE):

  • ANY INDIRECT OR CONSEQUENTIAL LOSS OR DAMAGE (AS DEFINED IN SECTION 4 BELOW) INCURRED BY ANY USER IN CONNECTION WITH ACCESS TO OR USE OF OUR SITES (OR INABILITY TO ACCESS OR USE OUR SITES), OR RESULTS OBTAINED FROM THE USE OF OUR SITES AND ANY OTHER INDIRECT LOSS OR DAMAGE OF ANY KIND;
  • LIABILITY (WHETHER DIRECT OR INDIRECT) IN RELATION TO ANY THIRD PARTY CONTENT OR MATERIAL POSTED ON OUR SITES OR WHICH MAY BE ACCESSED THROUGH OUR SITES; AND
  • LIABILITY ON ANY OTHER BASIS FOR CONSEQUENTIAL LOSS AS DEFINED IN SECTION 4 BELOW.
  • FOR THE PURPOSES OF THIS CLAUSE, CONSEQUENTIAL LOSS OR DAMAGE INCLUDES INDIRECT AND CONSEQUENTIAL LOSS AS GENERALLY UNDERSTOOD OR INTERPRETED ACCORDING TO THE LAW GOVERNING THIS CONTRACT AND INCLUDING LOSS OF BUSINESS OR PRODUCTION, LOSS OF PRODUCT, LOSS OF USE AND LOSS OF INCOME OR REVENUE, LOSS OF PROFIT OR ANTICIPATED PROFIT, LOSS OF CONTRACTS, LOSS OF OPPORTUNITY, GOODWILL, DATA AND LOSS OF SAVINGS OR ANTICIPATED SAVINGS.
  • LIABILITY FOR DIRECT LOSS OR DAMAGE IN RELATION TO THE FOLLOWING: LOSS OF BUSINESS OR PRODUCTION, LOSS OF PRODUCT, LOSS OF USE AND LOSS OF INCOME OR REVENUE, LOSS OF PROFIT OR ANTICIPATED PROFIT, LOSS OF CONTRACTS, LOSS OF OPPORTUNITY, GOODWILL, DATA AND LOSS OF SAVINGS OR ANTICIPATED SAVINGS.
  • THE ABOVE DOES NOT EXCLUDE OR LIMIT OUR LIABILITY FOR DEATH OR PERSONAL INJURY ARISING FROM NEGLIGENCE, NOR LIABILITY FOR FRAUDULENT MISREPRESENTATION, NOR ANY OTHER LIABILITY WHICH CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

Information about you

Any personal data you provide to us is protected under the Data Protection Act 1998 (DPA) and equivalent legislation elsewhere in Europe based on the European Data Protection Directive 95/46/EC and privacy laws in each relevant country (as amended). We are registered with the UK Information Commissioner in relation to the processing of personal data (registration number is Z9026044). In accordance with the DPA, we confirm that personal data submitted will be processed lawfully and fairly by us and that we shall take appropriate measures to ensure that the personal data we hold is (a) accurate, relevant and not excessive (b) kept up to date and not retained for longer than is necessary, and (c) kept secure to prevent access by people other than authorised personnel who require access on a “need to know” basis for the purposes of dealing with your application.

WE WILL ONLY TRANSFER PERSONAL INFORMATION TO A COUNTRY OUTSIDE THE EUROPEAN ECONOMIC AREA IF YOU HAVE INDICATED TO US THAT YOU AGREE YOUR PERSONAL INFORMATION MAY BE TRANSFERRED TO THAT TERRITORY AND THEN ONLY TO THE EXTENT PERMITTED UNDER APPLICABLE LAW.

NOTHING SET OUT IN THESE TERMS AFFECTS YOUR STATUTORY RIGHTS UNDER THE DPA.

You have the right to request information on the personal data we hold about you (for which we may make a small charge to cover the cost of administration), to have any inaccuracies corrected or to have your information removed from our database. You can do this by emailing us. Please note that we reserve the right at any time to seek further documentation or information from you as may be necessary in order to verify your identity before dealing with any such request.

We will hold any information that you provide to us for as long as may be necessary for the purpose of providing services to you or in certain cases where information may need to be retrieved at a later date to establish legal rights or defend any relevant claims. (For example, if you contact us with a query or complaint, we may keep a record of that correspondence or if you enter into a contract with us or any of our partners we may need to retain relevant information for the statutory limitation period under applicable law). From time to time we may contact you for administration purposes in relation to your application or our service, or to participate in surveys about our services, and we may record your responses. If we collect any other information from you, we will tell you at the point of collection why we are collecting it and what will be done with it.

We log visitors’ domain and IP addresses automatically. This information does not identify you as an individual, but only the computer that is being used to view our sites. This data is used to see where our sites are being used in the world to ensure coverage, and for click stream analysis to help better understand site usage, so that we can improve our service to you. We do not link information automatically logged by such means with personal data about specific individuals.

We may collect anonymous visitor information like IP addresses, browser types (such as Internet Explorer or Netscape), referring pages, pages visited and time spent on the website through use of web tracking software, cookies posted to the hard drive of your computer, or other similar technology. We collect this information: (a) to provide anonymous statistical analysis of web page traffic patterns for our sites; (b) to administer our sites and servers; (c) to allow for auditing of our services by authorised third parties; and (d) to improve our sites. You may choose not to receive cookie files by enabling your web browser to prompt you before accepting a cookie and/or refuse to accept cookies. Please note that by refusing to accept a cookie, you may not be able to access some features offered by our sites.

We do not and cannot combine traffic analysis information in relation to site visitors with personal information such as name, age, phone number or mailing address.

We may disclose information to any member of our group of companies in the event that such disclosure is required in the course of our normal business. We may need to disclose your information in the event that we sell or transfer any part of our business in which case you will be notified when your personal data is transferred to a new entity. We may also need to disclose your information in order to comply with any legal or regulatory obligations, to protect our rights, property or other customers, or to assist other companies or the authorities in fraud protection or investigation of suspected criminal activity. Please note that in any event, your personal data will not be processed for any additional purpose other than as set out in these terms or as previously permitted by you.


Viruses, hacking and other offences

You must not misuse our sites by knowingly or recklessly introducing viruses, trojans, worms, logic bombs or other material, which is malicious or technologically harmful. You must not attempt to gain unauthorised access or attempt to attack our sites or systems on which our sites are stored, or any server, computer or database connected to our sites (for example, through a denial-of-service attack or a distributed denial-of service attack). By breaching this provision, you may commit a criminal offence under the Computer Misuse Act 1990 (as amended). We will report any suspected illegal activity to the relevant law enforcement authorities and we may co-operate with those authorities by disclosing your identity to them.


Linking to our sites

You are prohibited from establishing or facilitating a link to our sites unless you have first obtained our express written permission to do so. You should submit any such request to us and provide relevant details about the link and your organisation, as we may request. We are under no obligation to accept such requests and may grant permission subject to certain conditions. You must not establish a link to our sites from any website that is not owned by you or do anything to suggest any form of approval or endorsement of you or your organisation on our part, where none exists.

Our sites must not be framed on any other site, nor may you deep-link or create a link to any part of our sites other than the home page. We reserve the right to withdraw linking permission without notice. The website from which you are linking must comply in all respects with any applicable local, national or international law or regulation. If you wish to make any use of material on our sites other than that set out above, please address your request to us.

Where our sites contain links to other sites, material and resources provided by third parties, these links are provided for your information only. We have no control over the contents of those sites or resources, and accept no responsibility for them or for any inaccuracies or errors or for any loss or damage that may arise from your use of them. You should also check the terms of use or privacy policies that govern those sites as they may be different from these terms.

We may revise these terms of use at any time at our discretion as required to deal for example with any changes to our business, the services provided or applicable law. You are expected to check this page from time to time to take notice of any changes we may make, as they are binding on you.
